Will “Live-in” Relationship Safeguard The Rights Of A Woman?
The decision that the Maharashtra state Govt. has taken sometime ago, about legalizing the “live-in” relationships, has brought a change of status for the woman, particularly in India. The recent move has been applauded by some groups while some others take this in negation. The main objective here is to protect and safeguard the rights of a woman; the amendment has been sought with the definition of “wife”. This step has been taken in order to make sure justice for women, who are deprived of the legal rights of being a spouse. The cabinet of the states has thus introduced a step that has become a debatable issue.
In Indian constitution, the clause B of section 125 of CrPc, deals with the maintenance amount claim, “the definition of a wife includes a woman who has been divorced by or has obtained a divorce from her husband and has not re-married and shall also include a woman who was living with the man like a wife for a reasonably long period.”- The quoted portion is the proposed additions that are based on the recommendations of Justice Mallimath Criminal Procedure Reforms Commission.
This attempt clearly shows the step that has been taken to protect the rights of a female in a relationship, it also ensures financial stability. By this the man in the relationship also gets to know about the responsibilities, though the relationship doesn’t get a status of legal marriage. The Law and Judiciary Department of the Govt. of Maharashtra has made the move of the proposal to the Cabinet Level. The Cabinets proposal will later be sent to the centre to obtain a nod or assent from the President.
The best thing will be that the benefits of alimony will give an added advantage, especially for women who are not financially independent. As it has been observed that majority of women are deceived by men who stay with them for years and move out for their convenience. The issue has come under a social scanner.
Youngsters find it a suitable way to run away from the responsibilities and commitments that comes along with the baggage of marriage. With the obvious question rolling whether now women will have to face prolonged divorce procedure in case the couple chooses to break-up and the love child out of the marriage will be given a legitimate status? However the Gen N has given welcome for the change, as the respect and status will automatically come for woman after this law.
